Certificate of No Harassment (CONH)

To pull permits for material alterations to a residential building in certain designated neighborhoods, you need a CONH — a certification from HPD that no tenant harassment has occurred at the building in the past 3 years.

Who needs it

Buildings in designated pilot-program neighborhoods (SoHo/NoHo, parts of Manhattan Community Boards, Chinatown, LES, Two Bridges, Inwood, Washington Heights, etc.). Check DOB's list.

Common denial reasons

  • Prior harassment findings against the owner
  • Improper vacatur of rent-regulated tenants
  • Recent HPD Class C violations from disrepair

Timeline

3–6 months typical. Plan permits accordingly.
