1. Acceptance of Terms

By accessing or using Pijexa ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions, then you may not access the Service.

2. Description of Service

Pijexa is a property management software platform that enables property owners, managers, and tenants to manage properties, units, leases, payments, maintenance requests, and communications.

2.1 Beta Service Notice

IMPORTANT: Pijexa is currently in BETA. By using the Service during the beta period, you acknowledge and agree to the following:

  • No Service Level Agreement (SLA): During the beta period, we do not guarantee any specific uptime, availability, or response times. The Service may experience interruptions, downtime, or degraded performance without notice.

  • Features May Change: Features, functionality, and user interfaces may be modified, added, or removed at any time without prior notice as we continue to develop and improve the platform.

  • Data Handling: While we implement industry-standard security measures and perform regular backups, we make no guarantees regarding data preservation during the beta period. We strongly recommend maintaining your own records of critical information.

  • Known Issues: The Service may contain bugs, errors, or other issues that could affect functionality. We appreciate your patience and feedback as we work to resolve them.

  • Support: During beta, support is provided on a best-effort basis. Response times may vary.

By continuing to use Pijexa during the beta period, you accept these conditions and understand that the Service is provided on an "as-is" and "as-available" basis with additional limitations beyond our standard disclaimers.

3. User Accounts

3.1 Account Creation

To use our Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Types

  • Property Owners: Can create properties, manage units, and oversee operations

  • Property Managers: Can manage assigned properties on behalf of owners

  • Tenants: Can access their unit information, pay rent, submit maintenance requests

  • Super Admins: Platform administrators with full access

4. Subscription and Fees

4.1 Subscription Tiers

Pijexa offers multiple subscription tiers (Free, Basic, Professional, Enterprise). Features and pricing vary by tier. See our pricing page for current rates.

4.2 Payment Terms

Subscription fees are billed monthly or annually in advance. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

5. Acceptable Use

5.1 Prohibited Activities

You agree not to:

  • Violate any laws or regulations

  • Infringe on intellectual property rights

  • Upload malicious code or viruses

  • Attempt to gain unauthorized access to the Service

  • Use the Service to harass, abuse, or harm others

  • Submit false or misleading information

  • Use the Service for any illegal housing discrimination

5.2 Fair Housing Compliance

All users must comply with the Fair Housing Act and applicable anti-discrimination laws. Discrimination based on race, color, national origin, religion, sex, familial status, or disability is strictly prohibited.

6. Data and Privacy

6.1 Data Ownership

You retain all rights to the data you submit to the Service. By using the Service, you grant us a license to use, store, and process your data as necessary to provide the Service.

6.2 Privacy Policy

Our collection and use of personal information is described in our Privacy Policy.

6.3 Data Retention

We retain your data as long as your account is active and for a reasonable period thereafter as required by law or for legitimate business purposes.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Pijexa and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Third-Party Services

The Service may integrate with third-party services including:

  • Stripe for payment processing

  • Screening services (Rentspree, TransUnion, Checkr, TurboTenant)

  • Email service providers

Your use of these third-party services is subject to their respective terms of service.

9. Termination

9.1 Termination by You

You may terminate your account at any time by contacting support or using the account deletion feature.

9.2 Termination by Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

9.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. You may request a copy of your data before deletion.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIJEXA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

12. Indemnification

You agree to indemnify and hold harmless Pijexa and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by applicable laws, without regard to conflict of law provisions.

13.2 Arbitration

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.

16. Miscellaneous

16.1 Entire Agreement

These Terms constitute the entire agreement between you and Pijexa regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

16.3 Waiver

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
